Laws and Regulations

Accommodations are provided in accordance with the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act, as well as other state and federal laws, which require that institutions of higher education provide accommodations and ensure equal access to programs and activities for students with Disabilities.

Under the Americans with Disabilities Act, an individual with a Disability is a person who "has a physical or mental impairment which substantially limits one or more major life activities, has a history or record of such an impairment, or is perceived by others as having such an impairment."

WVU Board of Governors Rule

BOG Governance Rule 1.6 also specifically mandates disability accommodation as part of its comprehensive anti-discrimination and Title IX program: "[Discrimination] includes failure and refusal to provide reasonable accommodation, consistent with state and federal law, to persons with disabilities" (§ 3.2.2).
